Image Licensing & Virtual Staging Disclosure
Not yet published
Preliminary draft — requires legal review
1. What virtual staging is
Virtual staging digitally adds furniture and décor to a photo of a room. Digital furniture removal and cleanup remove items from a photo. Restyling shows a room with alternative digital furnishings. In every case, the furniture, décor and styling shown are not physically present in the property.
2. What we never change
- Walls, windows, doors, flooring, built-in fixtures, ceilings and other permanent architectural features.
- Views, room dimensions, natural light direction and the property’s condition.
- Defects, damage or anything a buyer would reasonably need to see.
We keep the original photo of every altered image, and deliver it with the altered version.
3. Disclosure
Wherever a virtually staged or materially altered image is published — including MLS listings, brochures, websites and social media — it should be clearly identified, for example with a caption such as “Virtually staged” or “Digitally altered — furniture is not included”. Follow any disclosure requirements of your brokerage, real estate board, and the Trust in Real Estate Services Act, 2002 (TRESA) and its regulations, as applicable. Where practical, show the unaltered original alongside it.
On listlab.ca, every staged, emptied or restyled image is labelled as digitally altered. Demonstration work created by ListLab is labelled as a demonstration and is never presented as client work.
4. Licence for delivered images
- On full payment, you receive a non-exclusive, non-transferable licence to use delivered images to market the specific property they depict, for as long as you market that property. [Scope to be finalised.]
- Copyright in photography we create remains with ShadowTek Solutions Inc. unless agreed otherwise in writing.
- Images may not be resold, used to market a different property, or used in a misleading way.
- We may use images in our portfolio only with the property client’s permission.
5. Photos you submit
By submitting photos, you confirm that you own them or are authorised by their owner to have them edited and to use the results commercially. We do not edit third-party listing photos without that authorisation.
6. Stock and demonstration images
Any third-party stock image displayed on this site is used under a licence verified to permit commercial use and digital editing, and is credited where the licence requires.
7. No guarantee of results
Virtual staging is a visualisation tool. It does not guarantee a sale, a higher price or a faster transaction.
